Terms & Conditions: Goldy Pelorus Competition
1. These Terms and Conditions govern the rules regarding participation in this promotion and the claiming of any prize.
2. By participating in this promotion, you agree to be bound by these Terms and Conditions.
3. Entry is only open to Australian residents aged 18 years or over, excluding residents in Australian Capital Territory and South Australia.
4. Associates of the Promoter and any member of their immediate family are not eligible to participate in this promotion. Associates means employees of the Promoter, participating outlets and agencies associated with this promotion. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child, sibling, parent, grandparent, uncle, aunt, niece, nephew, or cousin, including step-relations and adoptive relations.
5. The promotion will be run in any venue in Australia excluding Australian Capital Territory and South Australia that agrees to participate in this promotion and displays promotional material advertising this promotion (each a Participating Venue).
6. The Promotional Period commences at 12.01am on Tuesday October 1st 2024 and ends at 11.59pm Tuesday December 31st 2024.
7. To be eligible to enter, individuals must purchase a “Goldy Lager Carton (24x375mL)” at a Participating Venue during the Promotional Period (Qualifying Transaction), AND scan upload their receipt to the competition portal online at cbco.beer/pages/competition-pelorusprivateislandgiveaway.
8. The Promoter may, at any time, make enquiries to verify the details of any entrant or entry and reserves the right to disqualify any entrant or entry if the Promoter is of the view there has been a breach of these Terms and Conditions. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
9. You are entitled to submit multiple entries, provided that: (a) only one (1) entry is permitted per Qualifying Transaction regardless of the number of eligible products purchased in that transaction; (b) a maximum of one (1) entries are permitted per person per day in a Participating Venue; and (c) each entry must be submitted separately and in accordance with these Terms and Conditions. It is the responsibility of each entrant to ensure they have correctly completed and submitted the online entry form.
10. Incomplete, indecipherable or illegible entries will be deemed invalid.
11. The draw will take place at the offices of Head On Agency, Level 1, 300 Victoria Street, Richmond, Victoria 3121 at approximately 12pm on Wednesday 8th January 2025. One (1) x winner will be contacted using the data provided in their competition entry.
12. The first valid entry drawn will win the prize/s as advertised in this Participating Venue (Prize). Additional reserve entries may be drawn and recorded in order in case an invalid entry or ineligible entrant is drawn. The winner will be notified in writing within 7 days. The winners details (last name, first name initial and postcode) will be published online at cbco.beer/pages/competition-pelorusprivateisland
13. The Prize consists of the following:
- Eight (8) x Return flights to Townsville from nearest capital city
- Four (4) x Twin Share, or equivalent, accommodation with Promoters elected accommodation partner – ARDO Hotel in Townsville for one (1) night
- One (1) x Pelorus Private Island Experience for eight (8) people for four (4) nights, inclusive of;
- Eight (8) x Return Helicopter Transfers from ARDO Hotel to Pelorus Private Island
- Trip dates are subject to availability
- All guests must be over the age 18.
- Total National Prize valued at $125,000 AUD. There is no individual State prize pool.
14. If for any reason the winner does not redeem their Prize within 14 days of notification, then the Prize will be forfeited at the Promotor’s discretion. There will not be an unclaimed prize draw.
15. A participating venue will not offer this promotion as an inducement directed at encouraging patrons to consume alcohol in line with relevant state liquor authorities.
16. The Prize is not transferable or exchangeable and cannot be taken as cash. The Prize value is correct as at the date of preparing these Terms and Conditions and include any applicable GST. The Promoter is not responsible for any change in prize value.
17. Entrants agree that if the Prize is unavailable for any reason the Promoter may provide another item of equal or higher value, subject to any necessary approval by the state/territory gaming authorities.
18. Any VIC winner of the Prize will have their name published online at cbco.beer/pages/competition-pelorusprivateisland on the date as advertised in this Participating Venue.
19. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
20. The Promoter collects personal information (Information) in order to conduct the promotion and may, for this purpose, disclose such Information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on your provision of Information subject to these Terms and Conditions.
21. The Promoter will use and handle Information as set out in its Privacy Policy, which can be viewed at https://cbco.beer/policies/privacy-policy. In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the Information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. The Privacy Policy also contains information about how entrants may opt out, access, update or correct their Information, how entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter.
22. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, pandemic, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant or entry; or (b) to modify, suspend, terminate or cancel the promotion subject to any written directions from a regulatory authority.
23. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion or any prize.
24. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of a prize.
25. All consumers of alcohols are encouraged to enjoy alcohol responsibly. Legal aged consumers are advised to consider the safe drinking levels recommended in the National Health & Medical Research Council Australian Alcohol Guidelines that are available at www.nhmrc.gov.au. Entry and continued participation in this promotion, including prize claims, is subject to the licensee’s liquor serving policy.
26. The Promoter’s decision is final and no correspondence will be entered into.
27. The Promoter is Morris Hospitality Pty Ltd (ACN 132 266 061) atf Morris Hospitality Trust trading as CBCo Brewing of 89 Bertie Street, Port Melbourne VIC 3207 (ph: 03 8644 4044) (“Promoter”).
28. Helicopter Restrictions (Excess Weight & Baggae): Due to safety requirements and space restrictions on the helicopters, all passengers are restricted to maximum of 15kg baggage allowance in total per person. Your 15kgs includes all handbags, camera bags and luggage, with all baggage weighed at check-in. Soft duffle or cabin bags are required as they are able to fit in the helicopter boot (no hard base or suitcases please). Due to space limitations please do not bring one large bag between two guests.
In some instances, the pilot may ask you to re-pack into a supplied soft duffle bag if your luggage is too large. Rest assured, we can securely store any of your excess luggage or hard cases at our hangar for pick up on your return trip. To assist, Pelorus Private Island Lodge offers a complimentary laundry service for all our guests while staying on the island (dry cleaning is not available).
Please be advised that the carriage of excess baggage cannot be guaranteed due to aircraft availability and payload limitations. In special circumstances a private charter may be required to bring requested excess luggage to the island at an additional cost. If you have any concerns regarding your baggage please contact us prior to your arrival so we can assist you.
Each helicopter type is limited to certain payload restrictions. Should a passenger’s individual body weight have a variance of more than 10% from their initially quoted weight at the time of booking, Nautilus Aviation reserves the right to charge an additional upgrade fee.
Your helicopter transfers will only be confirmed once your individual bodyweights (kg) are provided. If guest weights are not supplied at time of booking, an upgrade cost for a private charter or larger helicopter may apply.
